These terms and conditions govern every repair service and every supply of the MLK-POS checkout system by SMARTPOINT. They apply as soon as a device is handed in, a quote is accepted or an MLK-POS system is ordered.
1.Identification of the trader

These details are provided in accordance with Article III.74 of the Belgian Code of Economic Law and Book XII of the same Code.
2.Scope
These terms apply to all our services: repair of phones, tablets, computers and drones, as well as the sale, installation and maintenance of the MLK-POS checkout system.
Any conflicting terms of the customer are binding only if we accepted them in writing. If a clause is held void, the remaining clauses continue to apply in full.
3.Quotes, prices and payment
We diagnose first and quote second. No work starts before you approve the quote.
Prices for consumers are stated in euro, including Belgian VAT. Prices for business customers are stated excluding VAT.
Unless agreed otherwise in writing, payment is due when the device is collected or when the installation is delivered. Where a business customer pays late, the Belgian Act of 2 August 2002 on late payment in commercial transactions applies.
4.Repair conditions
- Diagnosis always precedes the quote. If you decline the quote, the device is returned in the state in which it was received, subject to the disassembly required for the diagnosis.
- You warrant that you own the device or are authorised to have it repaired. We may refuse a device whose origin appears doubtful and, where appropriate, notify the authorities.
- Some repairs, particularly at logic-board level, carry an inherent risk linked to the condition of the device. We inform you before intervening.
- Opening a device may end the manufacturer's warranty. We warn you where this is relevant.
- We use original parts or parts of equivalent quality; the nature of the part is stated on the quote.
5.Backups and data loss
You are responsible for backing up your data before any intervention, and we expressly invite you to do so.
We act with the care of a diligent professional, but we cannot be held liable for data loss resulting from an intervention, save for gross negligence or wilful misconduct on our part. This limitation does not apply to personal injury, nor in cases where Belgian law prohibits it.
6.Lead times
Announced lead times are good-faith estimates based on parts availability. A reasonable delay gives no right to compensation or termination, unless a deadline was agreed in writing as essential.
7.Uncollected devices
We notify you as soon as the device is ready. After three months from that notice, and following a written reminder that went unanswered, reasonable storage fees may apply and we reserve the right to dispose of the device in compliance with Belgian law, in particular the rules on waste electrical and electronic equipment.
8.Legal and commercial guarantee
Consumers benefit from the two-year legal guarantee of conformity on goods sold, under Book VI of the Belgian Code of Economic Law. That legal guarantee cannot be excluded or limited by these terms.
In addition, we grant a commercial guarantee on the repair service and on the replaced part. Its duration is stated on the invoice or the repair slip.
The commercial guarantee does not cover: damage occurring after the repair (drop, impact, liquid), normal wear, work carried out by a third party, or faults unrelated to the repair performed. The consumer legal guarantee applies in any event.
9.Right of withdrawal
The 14-day right of withdrawal under Book VI of the Belgian Code of Economic Law applies to distance and off-premises contracts. A repair requested and carried out in our workshop is a contract concluded on our premises, so the right of withdrawal does not apply to it.
Where a distance or off-premises contract concerns a service and you expressly request immediate performance, you lose your right of withdrawal once the service has been fully performed, in accordance with Article VI.53 of the Code of Economic Law.
10.MLK-POS checkout system
- Supply of MLK-POS includes installation, pairing of the cash machine and the staff training agreed in the quote.
- The customer provides a compliant technical environment: suitable power supply, network and installation space.
- The right to use the software is granted on a non-exclusive, non-transferable basis for the term of the contract; the code and design elements remain our property.
- The customer remains solely responsible for complying with the accounting, tax and registered-cash-register obligations applicable to its activity in Belgium.
- MLK-POS contracts between businesses fall outside consumer law, without prejudice to the mandatory provisions of Book VI, title 3/1 of the Code of Economic Law on unfair terms between undertakings.
11.Liability
Our liability is limited to direct and foreseeable damage, capped at the amount invoiced for the service concerned. We neither exclude nor limit our liability in cases of fraud, gross negligence, personal injury, or where Belgian law prohibits it.
12.Customer reviews
Reviews published on this site come from identified customers who genuinely used our services. In accordance with Book VI of the Belgian Code of Economic Law, we do not publish, commission or edit fake reviews.
13.Complaints and dispute resolution
Send any complaint to info@smartpoint.be or raise it at the counter; we look for an amicable solution first.
Failing agreement, consumers may refer the matter to the Belgian Consumer Mediation Service, Boulevard du Roi Albert II 8 box 1, 1000 Brussels (consumerombudsman.be), or use the European online dispute resolution platform at ec.europa.eu/consumers/odr.
14.Governing law and jurisdiction
These terms are governed by Belgian law.
Any dispute falls within the jurisdiction of the courts of the judicial district of Brussels. This clause does not deprive consumers of the right to bring proceedings before the court of their domicile where Belgian or European law guarantees it.
